Non-judicial

How foreclosure works in Colorado

Most Colorado foreclosures are non-judicial, run by the county public trustee with a short court step.

Main steps and notices
  • At least 30 days before filing a Notice of Election and Demand, the lender mails a notice with the state foreclosure hotline number.
  • The public trustee mails notice within 20 days of recording and again 45 to 60 days before the sale, and publishes it for five weeks.
  • A court order under Rule 120 authorizes the sale.
  • The sale generally takes place 110 to 125 days after the Notice of Election and Demand is recorded.
Catching up before the sale
The borrower can cure until noon the day before the sale if a notice of intent to cure is filed at least 15 days before the sale.
After the sale
There is generally no right to redeem after the sale.
Before any of this starts
Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
Governing law
Colorado Revised Statutes § 38-38-100.3 et seq.
