Non-judicial

How foreclosure works in Utah

Most Utah foreclosures are non-judicial trustee sales.

Main steps and notices
  • The lender sends a pre-foreclosure notice with at least 30 days to cure.
  • The trustee records a notice of default. Three months must pass before the notice of sale.
  • The sale is published once a week for three weeks, the last 10 to 30 days before, and posted at least 20 days before.
Catching up before the sale
The borrower can reinstate for three months after the notice of default is recorded.
After the sale
There is no right to redeem after the sale.
Before any of this starts
Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
Governing law
Utah Code § 57-1-24 et seq.
