How foreclosure works in Oregon
Most Oregon foreclosures are non-judicial trustee sales.
- Main steps and notices
- The lender generally offers a resolution conference first, held within 75 days of the notice if the borrower takes part.
- The trustee records a notice of default, and the notice of sale reaches the borrower at least 120 days before the sale.
- The sale is published once a week for four weeks, the last at least 20 days before.
- No deficiency judgment is allowed after a non-judicial sale.
- Catching up before the sale
- The borrower can cure up to five days before the sale.
- After the sale
- There is no right to redeem after the sale.
- Before any of this starts
- Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
- Governing law
- Oregon Revised Statutes § 86.726 et seq.
