How foreclosure works in Oklahoma
Most Oklahoma foreclosures go through court. A non-judicial option exists, but a homeowner can insist on court for their homestead.
- Main steps and notices
- To force a court process, the homeowner gives the lender notice by certified mail at least 10 days before the sale and files it with the county clerk.
- The sale notice is mailed at least 10 days ahead and published for two weeks, the first at least 30 days before the sale.
- Catching up before the sale
- State law does not require a right to reinstate.
- After the sale
- The borrower can redeem until the court confirms the sale.
- Before any of this starts
- Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
- Governing law
- Oklahoma Statutes tit. 12 § 686, § 764; tit. 42 § 18; tit. 46 § 43
