Non-judicial

How foreclosure works in Idaho

Most Idaho foreclosures are non-judicial trustee sales.

Main steps and notices
  • The trustee records a notice of default. For a primary residence, the lender sends loan modification information and must decide an application within 45 days.
  • The notice of sale is mailed at least 120 days before the sale.
  • It's published once a week for four weeks, the last at least 30 days before the sale.
  • The buyer can evict 10 days after the sale.
Catching up before the sale
The borrower can reinstate up to 115 days after the notice of default is recorded.
After the sale
There is no right to redeem after the sale.
Before any of this starts
Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
Governing law
Idaho Code § 45-1502 et seq.
